Terms of Service

These Terms of Service ("Terms") govern your use of ProfitBird, a Shopify application operated by LeakShield Technologies LLC ("we", "us", "our"), a company registered in the State of Wyoming, United States.
By installing or using ProfitBird, you ("you", "your", "Merchant") agree to be bound by these Terms. If you do not agree, please uninstall the application.
1. Service Description
ProfitBird is a Shopify application that calculates your store's net profit by analyzing order data, product costs, shipping fees, transaction fees, and discounts. The service includes:
- Automated profit calculations based on your Shopify order data
- Daily or weekly email profit reports (depending on your plan)
- AI-generated business insights (paid plans)
- An embedded dashboard within your Shopify admin
2. Account & Eligibility
- You must have an active Shopify store to use ProfitBird.
- You must be the store owner or have authorization from the store owner to install and use the application.
- You are responsible for maintaining the security of your Shopify account. We are not liable for unauthorized access resulting from compromised Shopify credentials.
3. Subscription Plans & Billing
ProfitBird offers the following plans:
- Free — limited to 3 products with costs, weekly email report (Mondays only), 3-day profit trend.
- Starter ($9/month or $86.40/year) — unlimited products, daily AI-powered email reports, anomaly alerts, goal tracking.
- Pro ($19/month or $182.40/year) — all Starter features plus product-level P&L analytics, weekly AI reports, 90-day trends.
All paid subscriptions are billed through the Shopify Billing API. By subscribing to a paid plan, you authorize Shopify to charge your payment method on file. We do not directly process or store your payment information.
Annual plans are billed as a single upfront payment and include a 20% discount compared to monthly billing.
4. Cancellation & Refunds
- You may cancel your subscription at any time by uninstalling ProfitBird from your Shopify admin or by contacting us.
- Cancellation takes effect at the end of your current billing period. You will retain access to paid features until then.
- Refunds for monthly plans are not provided for partial billing periods.
- Annual plan refunds are available within 14 days of purchase if you have not actively used the service beyond the first week.
- All billing disputes should be directed to Shopify, as they process all payments on our behalf.
5. Data & Privacy
Your use of ProfitBird is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
- We access your Shopify order, product, and shop data solely to provide the ProfitBird service.
- We do not sell, rent, or share your data with third parties for marketing purposes.
- We do not collect or store your customers' personal information.
- Upon uninstallation, all your data is permanently deleted within 30 days in compliance with Shopify's GDPR requirements.
6. AI-Generated Content
ProfitBird uses artificial intelligence to generate profit summaries and business insights. These AI-generated analyses are provided for informational purposes only and do not constitute financial, legal, or professional advice.
While we strive for accuracy, we do not guarantee that AI-generated insights are error-free or complete. You should independently verify any important business decisions based on these insights.
7. Accuracy of Calculations
Profit calculations depend on the accuracy of the data available in your Shopify store, including product costs you enter and the order data Shopify provides. We are not responsible for inaccurate calculations resulting from:
- Missing or incorrect product cost data
- Shopify API data delays or discrepancies
- Currency conversion differences
- Tax calculations (ProfitBird does not account for taxes)
8. Acceptable Use
You agree not to:
- Use ProfitBird for any unlawful purpose or in violation of Shopify's Terms of Service
- Attempt to reverse-engineer, decompile, or extract the source code of the application
- Interfere with or disrupt the service, servers, or networks connected to ProfitBird
- Use automated scripts to access the service beyond normal application usage
- Resell, sublicense, or redistribute the service without our written consent
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. ProfitBird may be temporarily unavailable due to:
- Scheduled maintenance (we will provide advance notice when possible)
- Shopify platform outages or API changes
- Circumstances beyond our reasonable control
We are not liable for any losses resulting from service interruptions.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- ProfitBird is provided "as is" and "as available" without warranties of any kind, whether express or implied.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
- Our total aggregate liability shall not exceed the amount you paid for ProfitBird in the 12 months preceding the claim, or $100 USD, whichever is greater.
- We are not liable for business decisions made based on ProfitBird data or AI-generated insights.
11. Termination
- You may terminate these Terms at any time by uninstalling ProfitBird from your Shopify store.
- We may suspend or terminate your access if you violate these Terms, with 15 days' notice to cure the violation where possible.
- We may immediately terminate access in cases of severe violations, including abuse of the service or fraudulent activity.
- Upon termination, your data will be deleted in accordance with our Privacy Policy.
12. Governing Law & Disputes
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.
Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to attempt informal resolution by contacting us before initiating arbitration.
If you are located in the EU/EEA/UK, nothing in these Terms limits your rights under applicable consumer protection laws, and you retain the right to bring claims in your local courts.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you via the email address associated with your account at least 30 days before the changes take effect. Continued use of ProfitBird after changes take effect constitutes acceptance of the updated Terms.
